2 suspects in custody, charged in murder of Gabriel Rodriguez

Gun malfunction may have prevented deadly shooting

LUBBOCK, TX (KCBD) - 22-year-old Abel Rosales Jr. and 49-year-old Abel Rosales Sr. remain in the Lubbock County Detention Center Monday, charged in the Sept. 12 murder of 36-year-old Gabriel Rodriguez.

On Wednesday, Sept. 12, LPD officers responded to reports of shots fired at a home in the 2800 block of Baylor Street. Two brothers, 36-year-old Gabriel Rodriguez and 34-year-old Elias Rodriguez, were both found at the home and both had suffered injuries.

Gabriel was taken to UMC with serious injuries related to a gunshot wound and was later pronounced deceased. His brother Elias, had been struck on the head with a metal object. Elias was taken to UMC and later released.

Elias Rodriguez told police that Abel Rosales Junior and Senior entered their residence without their consent with the intent to assault them on Wednesday night.

He said Gabriel was shot and Elias was struck on the head with a metal object.

Elias said he chased both men out of the house and they fled in a green Subaru. Elias identified the men as Abel Rosales Junior and Senior.

A witness told police that Abel Rosales, Jr. entered the home first and saw the two brothers in the living room. He fired one shot in the ceiling and asked which one of the brothers had gotten into a fight with with his father earlier.

The witness said Gabriel stood up and Rosales, Jr. shot him in the chest. Then he attempted to shoot Elias Rodriguez but the gun malfunctioned.

The witness said Abel Rosales, Sr. then entered the home and started hitting Elias Rodriguez with a large metal pipe

Detectives discovered there had been an ongoing dispute between the two brothers and the two suspects.
