The most recent taser case makes the third taser-related lawsuit in the city in the past two years.
L.J. McAllen filed suit against a Lubbock police officer and the city of Lubbock, following a July traffic stop. McAllen claims the officer used excessive force and violated his constitutional rights. However, the officer says he used minimal force, consistent with the training he received.
The family of Juan Nunez III is also suing the city and a different Lubbock police officer. An autopsy into Nunez's death revealed he died as a combination of being tased, a brain injury and intoxication. Nunez died April 16, 2006. The Nunez family claims police used excessive force and violated Nunez's rights related to search and seizure.
The courts are still reviewing both lawsuits.
