LUBBOCK, TX (AP) - A state district judge is expected to formally clear Timothy Cole Tuesday. Cole died back in 1999, while serving a 25-year prison sentence for a 1985, Lubbock rape authorities now say he did not commit.
DNA testing cleared Cole and connected Jerry Wayne Johnson to the crime. He's serving a life sentence for separate rape convictions.
Judge Charles Baird is expected to reveal the legal reasoning behind his decision to exonerate Cole during a hearing Tuesday in Austin. Cole's is the first posthumous DNA exoneration in Texas history.
