Lawsuit over alcohol sales to be filed even before Lubbock Co. election

LUBBOCK, TX (KCBD) - A Lubbock judge granted a temporary restraining order against the city just before five o'clock Monday.

Two of Lubbock County's largest alcohol vendors say a city ordinance dealing with the potential placement of packaged stores if fatally flawed.

Majestic Liquor Stores Incorporated, owner of Crossed-Keys, Doc's, Double-T, the Cellar and Pinkie's inc. filed the lawsuit against the city of Lubbock and the Texas Alcoholic Beverage Commission.

The companies claim that the city zoned alcohol in such a way that it unfairly discriminates.  A Lubbock judge granted their request for a restraining order that prevents the city from granting alcohol applications.

The plaintiffs are further seeking to have the ordinance declared void.

Newschannel 11 is looking into this lawsuit and has contacted the parties involved.
