The man at the center of the missing plague vial case is due in court on Tuesday. Dr. Thomas Butler will appear before Federal Magistrate Nancy Koenig to see if he can be released on bail.
The judge will also set a date for an arraignment. Dr. Butler's attorney, Floyd Holder, told NewsChannel 11 that he would be meeting with the prosecutor Monday to discuss the case. Dr. Butler is expected to plead not guilty at his arraignment.
He faces five years in jail and a $250,000 fine if convicted of lying to federal authorities.
