Mother gets maximum sentence for abuse towards stepsons

LUBBOCK, TX(KCBD) - A Lubbock County jury has given Melissa Lively the maximum sentence behind bars for torturing her two stepsons.

It took the jury just under an hour to find Lively guilty on both charges of aggravated assault with a deadly weapon and another 50 minutes to sentence her to the maximum of 20 years behind bars and a total fine of $20,000.  

Back in 2006, police arrested Lively after officers found her 15-year-old stepson Joe Lively walking barefoot along I-27. Prosecutors say he and his brother Danny were malnourished, severely beaten, and burned with a battery charger by a family member. The two boys also suffered wounds from a BB gun.

The boys testified earlier this week, that Lively forced them to sleep on a mat in a garage closet. Jury members saw pictures of the boys' wounds and physical conditions. But the defense argued there was no evidence to prove that Melissa was the one who burned the boys with the battery charger.

The prosecution countered saying there may not be evidence that she did those things but they say Lively knew the acts were going on or even encouraged the acts.

Lively's husband, son, and a family friend named Kyle Sexton face similar charges, and will have their day in court at a later date.
