LUBBOCK, TX (KCBD) - A Lubbock defense attorney thrown behind bars for refusing to testify against his former client had his day in court on Tuesday.
A visiting judge from Austin found Ben Webb not guilty and dropped all charges.
The State subpoenaed Webb to testify against a former client back in June. He took the stand and refused to break his attorney client priviledge.
140th District Court Judge Jim Bob Darnell found him in contempt of his court because he did not answer prosecutor's questions and ordered him off to jail.
Webb spend about an hour in the Lubbock County Jail.
Rod Hopson, along with other local defense attorneys, packed the courtroom in support of Webb. "We are very happy Ben Webb is out of this situation. They'll agree to exponge this whole thing like it never happened. We are disappointed no hearing disappointed Judge Jim Darnell and prosecutors didn't appollogize for their actions." says Hopson.
Hopson issued subpoenas for two prosecutors and Judge Jim Bob Darnell although no one appeared in court.
