Business owner denies minimum wage violation


LUBBOCK, TX (KCBD) - A Lubbock man accuses Lisa West's Double Nickel Steakhouse of violating wage and hour laws, but the owner says that's not the case.

Lisa West, owner of the Double Nickel Steakhouse says, "We follow all federal wage and labor laws, and if by chance the server does not make regular minimum wage, cause they clock in at a server minimum wage, we bring them up to regular minimum wage."

Alex Imhoff filed a class action lawsuit on behalf of himself and several other employees. He claims the Double Nickel relies on "tip pooling" to avoid paying employees minimum wage and also paid floor managers and bookkeepers out of the pooled tips.

Imhoff claims the practice is invalid and the restaurant is prohibited from crediting tips toward payment of minimum wage.
