A Houston judge released a convicted rapist Wednesday after re-tested DNA evidence showed that he wasn't a match to the attacker.
21-year-old Josiah Sutton was convicted for the 1998 rape of a woman at gunpoint. Sutton walked out of jail Wednesday afternoon. This after, a lab found the Houston Police Crime Lab incorrectly linked DNA evidence to Sutton.
Attorneys will now seek a pardon from the governor.
