LUBBOCK, TX (KCBD) - Judge Jim Bob Darnell will continue to hear criminal cases in Lubbock County after a motion filed by Rod Hobson to recuse Darnell from all criminal cases involving the Lubbock County Criminal District Attorney's Office was denied.
Hobson claimed Darnell was indebted to the criminal district attorney's office for giving his son preferential treatment on a 2008 DWI charge and cannot be impartial in any criminal case as a result.
John Grace, a civil district attorney who represents the criminal district attorney's office, denies Darnell's son received preferential treatment and says Hobson's claims of impropriety are purely speculative.
In July 2008 Jared Darnell was seriously injured in an auto accident and was taken to a hospital but was not arrested even though his blood alcohol concentration was 0.193 - more than twice the legal limit.
Darnell was never arrested and was offered a pretrial diversion before a warrant was served.
