Appellate court rules Plainview Police officer can be sued for 2006 shooting death

LUBBOCK, TX (KCBD) - An Appellate Judge says a Plainview police officer can be sued for the 2006 death of 34-year-old Jose Ceballos.

Ceballos died in September of 2006 after a disturbance at his parents home. Police say he locked himself and his parents inside the home. When officers kicked in the door, they say Ceballos came toward them with a knife. That's when Officer William Bridgewater shot him.

The Ceballos family disputes that account, and filed a wrongful death suit against the City of Plainview and 3 officers.

Friday the 5th Circuit Court of Appeals reversed a lower court ruling that Officer Bridgewater was not at fault, but upheld the dismissal of cases against Chief William Mull and Officer Jose Porras.
