LUBBOCK, TX (KCBD) –  The Lubbock District Attorney's Office files new charges against an Idalou man accused of using an 87-year-old woman's stolen ATM card.

Wednesday afternoon 21-year-old Joshua Paul Stephenson was charged with aggravated sexual assault. Police say they were able to identify Stephenson as a suspect in the burglary and rape of the elderly woman using his own DNA.

Detectives escorted Stephenson to court Wednesday afternoon to answer for the latest charge of breaking into an elderly woman's house and sexually assaulting her. Stephenson was silent when asking if he had anything to say to the 87-year-old's family.

Captain Greg Stevens with the Lubbock Police Department says the assault charge was filed as aggravated because of the age of the victim. The investigation has been going on for over two weeks. Police were flooded with tips from CrimeLine after they released surveillance images of a man using the victim's stolen debit card.

Through tips they were able to identify Stephenson and Idalou police brought him to the Lubbock County Jail last week. A search warrant was issued for his DNA. Court documents say DNA collected from Stephenson at the jail matched physical evidence left at the scene.

"Fortunately a lot of things in this case worked out. The pictures came out and the physical evidence was available," says Cpt. Stevens.

According to court documents police say the victim tearfully told them she was asleep when her attacker shined a bright light in her face. She said she could not hear what he was yelling because she had removed her hearing aids. The 87-year-old was sexually assaulted. After her attacker left she realized all of her phones had been disconnected.

Originally police investigated a possible link between Stephenson and the twilight rapist. "This case is not connected to twilight rapist cases in Central and South Texas," says Cpt. Stevens.

There is still no clear answer on whether or not the attack was random or planned that is part of the ongoing investigation. Stephenson faces charges for the sexual assault and debit card abuse. If convicted he faces up to life in prison. He is behind bars on $575,000 bond.
