LUBBOCK, TX (KCBD) - An arrest has been made in the Tech Terrace assault case. Bailee Barrett, 19, was arrested in her dorm room at Stangel Hall on the Texas Tech campus around 1:30 p.m. on Friday.
Lubbock Police tell us she was booked and released with her attorney present at the Lubbock County Jail. She is charged with a misdemeanor assault and her warrant had a $7,500 bond.
This happened on Saturday night in the Tech Terrace neighborhood, in the 3200 block of 22nd Street. Sherry Grusendorf lives in the neighborhood and says she was attacked by Barrett after she was checking on another female who was lying in her yard.
Grusendorf says Barrett grabbed her neck, pushed her down, and attempted to kick her, before a neighbor and other party goers came to her rescue.
On Wednesday, Grusendorf filed a civil lawsuit against the homeowners of 3202 22nd Street, who hosted the party the night of the attack. This is a class A misdemeanor and Barrett could face a fine up to $4,000 and or up to a year in jail.
At first this crime was considered an aggravated assault, but the actual charges are not as serious. "The elements in the offense of aggravated assault requires a victim to have received serious bodily injury and in this case it would be hard to prove up for a jury," said Lt. Neal Barron with the Lubbock Police Department.
The 62-year-old victim, Sherry Grusendorf says she still can not this whole incident happened. "I have to say I feel sorry for her. I can't think of anything worse than being arrested. I'm sorry that it has come to this, but people have to be responsible for their actions," said Grusendorf.
