Board recommends clemency for Timothy Cole

LUBBOCK, TX (KCBD) - A Texas Pardons and Parole Board recommends clemency for Timothy Cole.

Cole died behind bars in 1999 after he was wrongly convicted of the 1985 rape of a Texas Tech student in Lubbock. A DNA test last year cleared Cole and implicated convicted rapist Jerry Wayne Johnson actually committed the crime.

The board sent their recommendation to Governor Rick Perry on Friday. Perry has indicated he will pardon Cole, and assuming he does this will be the first posthumous pardon in Texas.
