Newly hired animal services director is suing city

LUBBOCK, TX (KCBD) - KCBD NewsChannel 11 has confirmed that the city has hired a new animal services director. She is Martha Ellerbrook, who replaces fired director Kevin Overstreet. Overstreet claimed retaliation at the time of his firing in late 2009.  

But that's not the only claim of retaliation. Less than one year ago Ellerbrook filed a retaliation lawsuit against the city. She was a former city employee subject to RIF or reduction in force back in 2003.

Her lawsuit is still pending and on Tuesday Judge Sam Cummings ordered the case to go to trial in October of 2010. KCBD NewsChannel 11 was not able to find out whether or not her hiring might be tied to a possible settlement. 

Ellerbrook's husband, Terry Ellerbrook, also filed a lawsuit against the city, which was settled out of court back in March 22 of 2007 for $250,000.00.  Public records as recently as January 21st indicated that Mr. Ellerbrook is still employed by the city in the solid waste department.
