LUBBOCK, TX(KCBD)- In 1999 Timothy Cole died in prison after being wrongfully convicted of the 1985 rape of a Texas Tech student. DNA testing later proved his innocence and Texas Governor Rick Perry granted him a posthumous pardon in March of 2010.
Now, Cole's family wants to question the officers who gathered the evidence in the case. The attorneys for the city of Lubbock do not want the officers talking to the Cole family. The city wants the judge in the case to dismiss the request. There is no word on when the judge will make his decision on the matter.
