Ellerbrook, City of Lubbock request restrictions in lawsuit


LUBBOCK, TX (KCBD) - Lubbock's newly hired Director of Animal Services does not want the City saying anything bad about her husband in federal court.

That's one of the requests Martha Ellerbrook filed in her ongoing lawsuit against the City - which was filed long before she was hired.

Ellerbrook claims she was passed over for a different city job because she was helping her husband, Terry Ellerbrook, sue the City back in 2006.

And while Ellerbrook wants restrictions on the City, likewise, the city also wants to put restrictions on what Ellerbrook can say in court.  The city filed a motion to stop her from mentioning the fact that the City has liability insurance. The City fears it would sway the jury's opinion.

Meanwhile, documents added to the case Monday afternoon give a detailed explanation as to why the City refused to negotiate an out of court settlement back in January.
