LEVELLAND, TX (KCBD) - A Well known Levelland surgeon will not be charged with a felony after all. Doctor Harry Weaver, 50, posted bond to get out of jail on June 22nd. Levelland Police arrested Weaver late Saturday night (June 19th) on a family violence, aggravated assault charge, which would have been a felony.

However, Thursday morning Hockley County District Attorney Gary Goff told KCBD NewsChannel 11 that "it doesn't rise to the level of a felony." Goff referred the case to the County Attorney as a misdemeanor. Meanwhile, County Attorney Christopher Dennis was not available for comment or further details.

Police records from June show Weaver punched his wife multiple times in the face and the back of the head after she confronted him about text messages she found on his cell phone. Police who responded to the hospital say her face was swollen and bruised, and that when asked, she said this was not the first time he had attacked her.
