PLAINVIEW, TX (KCBD) - A Hale County Commissioner is on trial starting Tuesday, accused of two felonies.  Gary Koelder, Precinct 3 Commissioner of Hale Center is indicted for "abuse of official capacity" and "theft of property by a public servant."

To this point the special prosecutor has not given out details of what Koelder is accused of doing.  Koelder was elected in 2004 and re-elected in 2008.  Despite an objection Monday that the special prosecutor was not properly appointed the trial continued Tuesday with the sitting of a jury.  

In an unrelated case back in 2009 Hale County Commissioner Neal Burnett was accused of stealing county gasoline and resigned.  Burnett  agreed to serve three years probation as part of plea bargain.
