City employee may continue suing the city, judge rules

LUBBOCK, TX (KCBD) –  A judge rules that Lubbock's Animal Services Director, Martha Ellerbrook, can continue her lawsuit against the city.   

Ellerbrook actually sued the city prior to being hired, saying she had been passed over for a different job as retaliation for her husband's lawsuit against the city, which was settled out of court in 2007.  More recently the city made a motion to dismiss the case on summary judgment.
