Grand Jury declines to indict 90-year-old-man

LUBBOCK, TX (KCBD) -

A Lubbock County Grand Jury has declined to indict a 90-year-old man who was accused of shooting at police.

Willie Williams was charged with two counts of aggravated assault on a public servant.

Police say they were responding to a burglary call at the at Parkridge Place Apartments around 2:30 a.m. on Sept. 25. Authorities say the suspect was gone when they arrived. According to police, Williams fired a shot near the officers during the incident and police returned fire, striking Williams once in the arm.

Police say the original burglary suspect was gone by the time they arrived. Williams' family says he may have mistaken the officers for the suspect.

Family members told KCBD NewsChannel 11 that Williams has hearing problems and that he was trying to defend himself during the burglary attempt.

Typically, the Lubbock County District Attorney doesn't bring a case back to a grand jury unless there is new evidence.
