No jury trial for controversial Alpha Tex Kennels

FLOYD COUNTY, TX (KCBD) -

The owners of Alpha Tex Kennels will not get a jury trial in Floyd County, according to the Floyd County Hesperian Beacon.  The paper says instead there will be a November 17th hearing at 9 AM. 

In late September Sheriff's Deputies seized more than 200 dogs from Alpha Tex, several miles outside Lockney.  KCBD NewsChannel 11 video at the time showed sick dogs, feces in the water, and a fly infestation. 

The owners at the time said these were temporary problems.  But County officials said up to 80 percent of the animals suffered serious illness.

Justice of the Peace Tali Jackson had ordered a jury trial back in October but more recently the Floyd County Attorney Pro-Tem asked to have it canceled.  He argued that state law does not allow for a jury trial for possession of animals after allegations of animal cruelty.  Last week Justice Jackson agreed.

Public sentiment has been harsh against Alpha Tex; it has been equally harsh against certain County officials after word of a proposed out-of-court settlement.
