The City of Lubbock still wants to fire police officer Chris Hennsley.
The city did fire him back in 2010 for a long list of allegations including excessive force. Hennsley is accused of kicking a man in a traffic stop even though he had his hands up and had gotten out his car. But an arbitrator this month overruled the city and gave Hennsley his job back.
Now KCBD NewsChannel 11 has obtained the latest court documents in case. They say the arbitrator ruled against the city for what amounts to a paperwork problem.
Attorneys for the city also say the arbitrator simply got it wrong. The city says the arbitrator failed to consider a recent appeal court case.
Hennsley is now back on duty. A state district judge will decide if the arbitrator got it right.
