Normally the Alpha Tex case would be heard by the Floyd County Court At Law Judge, but instead, State District Judge John B. Board has been appointed to hear the case.
Lawyers for both Alpha Tex and for Floyd County will have a pre-trial hearing on January 6th in Amarillo.
Back in late September, the Floyd County sheriff seized roughly 200 dogs from Alpha Tex - amid claims of animal cruelty.
The owners then filed a motion with a local justice of the peace to get the dogs back.
Separately - they also filed a federal lawsuit against Floyd County.
The case is before Judge Board on appeal.
The lawyer for Alpha Tex has asked for several things, including a motion to get the dogs back and throw out the entire case.
