Charge in 1989 case upgraded to capital murder

LUBBOCK, TX (KCBD) -

A man accused of murdering an elderly woman was indicted for capital murder on Tuesday.

Reynaldo Rey, 48, was originally charged with murder but authorities say they were able to get the capital murder charge by proving the murder of 93-year-old Minnie Elkins involved robbery.

The murder case went unsolved for nearly 22 years until DNA evidence revealed Rey as a possible suspect.

Family members found Elkins' body in her Overton neighborhood home in June of 1989.

Minnie Elkins' daughter passed away back in September.

We spoke with Elkins' grandson on Tuesday.

He says his mother will never get to see justice because she is now dead.
