Father accused of driving drunk with child in car

LUBBOCK, TX (KCBD) -

A Lubbock man is facing criminal charges, after police say he drove drunk with his 10-year-old son in the car. Ricky Gilbert Herrera, 29, was arrested on March 22nd after police responded to a car accident at 50th St. and Ave. Q.

Investigators say Herrera was involved in the accident but was not hurt. During their observations, police believed Herrera's eyes were red, bloodshot and watery. They also noticed his speech was slurred and he was hard to understand. Officers say they smelled alcohol on his breath and inside of his vehicle. In the back seat of the vehicle, officers discovered a 10-year-old boy, who was not hurt.

According to court documents, Herrera was given a field sobriety test at the scene. Officers determined he was under the influence. He was transported to UMC for a mandatory blood draw and then booked into jail. He was charged with DWI with a child under the age of 15.

He has since posted bond of $5,000.
