Investigators Hold off on Investigating Baby's Death as Homicide

The Lubbock County Sheriff's Department told NewsChannel 11 they are waiting for more information before they can say their investigation into the death of 17-month-old Espiridion Garcia a homicide investigation. Chief Paul Scarborough tells us they have not received the required information to do so. "Essentially, we are waiting on all the material that will be available to come to us before we have anything to say about the case. If it is indeed a homicide, then we will treat it like any other active investigation and not discuss it publicly."

Espiridion was taken to Covenant Medical Center by Aerocare after he stopped breathing at his home in East Lubbock County a month ago. He was there with his mother and her boyfriend at the time. Espiridion died the next day after being taken off life support. At that time, investigators believed his death was suspicious. That day, Captain Bill Drewell told NewsChannel 11 "We have our suspicions about something, we're not sure."

Now the Lubbock County Medical Examiner's Office confirms Espiridion died of blunt force trauma to the head. They say his death should be treated as a homicide. When we asked Chief Scarborough if the medical examiner should have made that announcement, he said, "I don't have information that he has. I'm not going to say whether he should have or shouldn't have. I'm saying we don't' have the information that would tell us this is or isn't a homicide."

With news of the medical examiner's ruling, we went to seek comment from Espiridion's mother. No one came to the door, but her sister tells us Maria Vargas is living at the residence where Espiridion was hurt. Her boyfriend, 27-year-old Armando Lomas, is currently in Lubbock County Jail for outstanding traffic tickets.

NewsChannel 11 talked to Child Protective Services and they say Maria Vargas's two other children are still in CPS custody. This isn't the first time they has dealt with the family. There were reports of child neglect back in 2001. Those reports included mal-nourishment, lack of supervision, and alleged drug use by both Esperidion's mom and her boyfriend.
