WRBL in Auburn is reporting that a Federal judge has denied a motion to dismiss the civil suit against Texas Tech football coach Tommy Tuberville.
The suit alleges that a hedge fund that Tuberville helped manage defrauded clients of more than $1.7 million.
Tuberville's attorneys issued this statement on Monday:
"The denial was only a procedural issue. Coach Tuberville had moved to dismiss the original complaint or require the plaintiffs to amend their complaint. The plaintiffs elected to go ahead and file a new amended complaint ....which rendered moot the initial motion to dismiss because it is directed at the original complaint. Coach Tuberville will now file a motion to dismiss the amended complaint. I believe the amended complaint demonstrates that the plaintiffs never dealt with Coach Tuberville and that he had nothing to do with soliciting their investments."
