The final price tag for the City's legal battle with Martha Ellerbrook is $750,000.
Ellerbrook sued the city claiming she was passed over for a job in 2007 as retaliation. She won a jury verdict of $243,000 in Lubbock federal court last year. The judge overturned the jury's decision and Ellerbrook appealed. On appeal she won.
Since then Ellerbrook also has been seeking attorney fees. Under an agreement accepted by the City Council on Thursday, the verdict plus her attorney fees total $575,000. If the city's legal fees are also included the total becomes $750,000.
The City's insurance will pay everything above $500,000.
City Councilman Paul Beane was the only one to vote 'no' on the settlement.
