Mike Leach back in court Wednesday

LUBBOCK, TX (KCBD) -

Former Texas Tech Football Coach Mike Leach was back in court Wednesday for a hearing on a lawsuit involving ESPN, Spaeth Communications, and Craig James.

Spaeth Communications is a Dallas public relations and political consulting firm retained by the James family to handle the controversy.

This hearing comes more than three years after the university fired him.

Texas Tech claimed the coach mistreated former player Adam James when he had a concussion.

Lawyers for Leach say they have proof that there was actual malice in the way ESPN handled the events, saying ESPN made statements about Leach that they knew weren't true.

Leach's lawyers say he never specifically told James to go into what ESPN referred to on air as a "shed."

ESPN attorneys argued that they told the stories that were given to them by Adam's father, Craig James, who worked for ESPN at the time.

They also say they gave Leach the opportunity to come on air and give his side of what happened that day at practice.

One of Leach's attorneys, Steve Heninger, says the main goal for Wednesday's hearing was to once and for all, shed light on the truth, "To show the interrelationship that harmed Coach Leach and led to his termination."

Heninger says the next step is for the judge to decide if there is enough evidence to bring the case to trial.
