Lubbock man charged with intoxicated assault for school bus crash

LUBBOCK, TX (KCBD) -

A man who ran his car into a parked school bus at Lubbock High School earlier this year, seriously injuring his passenger, was indicted Tuesday.

24-year-old Brian Mogaka is charged with intoxicated assault.

The crash happened in January in the 1900 block of 19th St. Police say Mogaka veered into the lane the bus was parked in, slamming into it. The impact left his passenger, 30-year-old Alan Ogutu, with severe brain damage.

Ogutu is now unable to function on his own.

The bus was empty at the time.  

Police say Mogaka's blood alcohol level was more than three times the legal limit.
