Lubbock police say they will present information about Tuesday's fatality involving a vehicle hitting a pedestrian to a grand jury.
47-year-old Louis Barber and his wife were crossing Slide Road at 48th Street on their way to Denny's when he was hit by a car and killed. The vehicle was driven by 28-year-old Kyle Girgus.
Girgus was in the far right lane when he hit Barber, causing him to be thrown from his electric wheelchair.
Police say Barber and his wife were just feet from the Denny's parking lot when he was hit. Barber's wife says they frequently crossed in that area, which was two blocks from the nearest crosswalk.
Police responded to the accident around 10 p.m. and pronounced Barber dead at the scene.
Sgt. Robert Hook with LPD says they have been conducting an ongoing investigation to determine if alcohol, drugs or speeding contributed to the accident.
Hook says the jury will hear the case sometime this month.
Louis Barber leaves behind his wife and five children.
Barber's memorial service will be held Thursday evening at St. Luke's SW at 6 p.m. St. Luke's is located at 98th and Frankford.
