Smith Co. man faces three charges after running from deputy

SMITH COUNTY, TX (KLTV) -

A Smith County man faces three different charges after running from a sheriff's deputy Monday.

Cody Dwain Delaney, 25, of Tyler, is charged with taking a weapon from an officer, evading arrest or detention with a vehicle, and resisting arrest search or transport. He remains in the Smith County Jail and his bond has been set at $107,165.80.

After Delaney was pulled over in western Smith County near Highway 31, deputies learned he had outstanding traffic warrants from the City of Tyler. Lt. Gary Middleton said when Deputy Sherman Dollison tried to place Delaney under arrest "a struggle ensued" that involved Dollison trying to use his Taser.

"The Taser, you have to be so far away and during the struggle the officer [Deputy Dollison] could not get that separation for the Taser," Lt. Middleton said.

Dollison was treated for heat exhaustion due to the high temperatures combined with the chase and struggle with Delaney. He was treated by paramedics on the scene.

Dollison is known to many East Texans for working security at the Smith County Courthouse on the day of the 2005 courthouse shooting. He was shot several times during the shooting and had a long road of recovery before rejoining to the department.
