Land developers and owners continue their dispute with the City of Lubbock over a policy at Lake Alan Henry.
On Thursday, John and Gerald Huffaker, two attorneys from Amarillo and Tahoka spoke on behalf of the developers. They responded to a claim made by the city that developers have been in direct violation of the 300 foot easement restriction. The attorneys claim their clients and the city have tried to negotiate what can be done within that easement. John Huffaker, attorney for Ashley and Fagan says, "We believe the property owners should be able to improve their property to the extent that they can access the lake in a safe manner."
Councilman Tom Martin says the rules are the rules, and that the city will do what it takes to make sure they are followed. "They accuse us for not negotiating in good faith there's nothing to negotiate. It's like your neighbor coming over to your house and putting a barbecue pit in your lawn and saying they have the right to do it."
A hearing has been set for February.
