Council approves paid administrative leave for city attorney

LUBBOCK, TX (KCBD) -

The Lubbock City Council approved City Attorney Sam Medina's request for a paid leave of absence on Thursday. 

Council members spent more than an hour and a half in executive session before the decision came down shortly before 5 p.m., passing 4-1.

Mayor Pro Tem Karen Gibson the only council member who voted against it. Council member Latrell Joy asked to be excused because she's the lawyer representing Medina's son Erik.

Medina decided to take a voluntary leave of absence after a family member accused him of sexual assault.

He addressed the public Monday afternoon surrounded by his wife, two sons and his attorney, saying the accusations are absolutely false.

No details have been released about the allegations thus far and no charges have been filed.

Medina said his soon to be ex daughter in law has been going through a brutal custody battle with his son Erik and he didn't want to get the city involved in a messy divorce.

Lubbock Mayor Glen Robertson spoke with us live at on our 5 p.m. newscast and said the council needed to balance what was fair to Sam Medina with what was fair to taxpayers. He said the issue will be on every council meeting agenda until it is resolved.

Mayor Robertson said the council is keeping the issue on the agenda so they can react to new information and cancel or change the terms of Medina's leave if necessary.

When asked to give his personal opinion about the charges Mayor Robertson said, "Until this goes through the process, until we've had either charges filed or a grand jury look at it or a judge look at it, I'm going to presume that Mr. Medina is innocent."
