Prosecution plays sex tape for jury in Watson trial

LUBBOCK, TX (KCBD) -

Testimony began Tuesday in the trial for a former Texas Tech student accused of sexually assaulting another student back in 2012.

David Watson is accused of aggravated sexual assault of an adult, aggravated kidnapping, possession of child pornography, improper photography, and retaliation in connection with an alleged encounter with a fellow Texas Tech student on May 6, 2012.

Two witnesses took the stand Tuesday morning: the 911 dispatcher and a responding officer.

The 911 tape was played in court and the plaintiff can be heard saying, "Hi, I'm at someone's house and I've been assaulted."

The defense is arguing the act was consensual. 

Watson's attorney, Chuck Lanehart, says Watson and the student knew each other, sat next to each other in class, and "were friends with benefits."

Jurors endured a tense hour in the courtroom on Tuesday afternoon.

Prosecutors played a videotape where the defendant recorded sexual acts with the alleged victim. The recording was so difficult to listen to, one woman had to leave the courtroom.

At times, the plaintiff is obviously crying. In the recording, the defendant speaks forcefully to her - demanding that she do specific things while she cries out for him to stop.

Defense attorneys said in the past she would ask Watson to be more aggressive and that their client was just complying with her requests.

Shortly after 4 p.m. the alleged victim took the stand.

She admitted to knowing Watson from class and said they sat next to each other. She said they went on a few dates and had some sexual contact but she said it was nothing serious.

She said things changed when Watson texted her on May 5, 2012 saying, "It was in her best interest if she came to his house."

So she said she went. That's when she said Watson told her he had images and videotapes of her and said if she didn't do what he asked, he would put it all over the Internet.

That's when she said she was sexually assaulted. She started crying a few times while on the stand, one time specifically when she claimed she feared for her life because Watson had a knife.

The indictment also says the defendant used a knife, but several officers testified not knowing about a knife on the initial call.

The defense is arguing that the sexual acts were consensual.

Trial has recessed for the day. Testimony will continue Wednesday morning at 9 a.m.
