Watson found guilty of Sexual Assault

LUBBOCK, TX (KCBD) -

A jury has found David Watson, 23 guilty of Sexual Assault, but stopped short of the charge of Aggravated Sexual Assault.  23-year-old Watson was accused of raping a fellow Tech student in May 2012.

The jury went into deliberations at 11:30 a.m., took a short break for lunch, and handed down their guilty verdict right around 2:30 p.m.

After the verdict, as the court recessed, David Watson began to cry, turning to his family for comfort.

During the trial we learned that both of Watson's parents work in law enforcement, holding high-ranking positions in the Houston and Austin area.

Watson was found guilty of the lesser charge of sexual assault, not aggravated sexual assault, so he now faces 2 to 20 years in prison instead of 5 to 99 years or life in prison.

He will be eligible for parole, but Watson will have to register as a sex offender for the rest of his life.

The accuser's mother took the stand during the stand as the trial moved into its punishment phase, saying that this incident had made it difficult for her daughter to finish her studies.

The mother said she had trouble sleeping at night, still dealing with nightmares two years later.

The verdict came after a tense morning of closing arguments from both the prosecution and the defense.

Defense attorney Chuck Lanehart said the sexual acts were consensual because of a previous Skype conversation the victim had with the defendant, but prosecutor Wade Jackson was quick to object, saying consent comes not before, not after, but during the act.

Prosecutor Barron Slack said this was a calculated, pre-planed, vicious sexual assault against the victim. He said that was proven by a document they found on Watson's computer planning the release of photos and video if he was arrested.

District Attorney Matt Powell's closing arguments were the last thing the jury heard before they went into deliberation. Powell played the explicit recording of the incident for the jury, where they heard the victim screaming for Watson to stop.

Powell said the evidence literally screams rape.

The jury will continue on to the sentencing phase of the trial on Tuesday.
