Rape victims file lawsuits against apartment complex management

(WMC) - Three women who were the victims of burglary and rape by gunpoint at The Abington apartments filed separate lawsuits that each seek $5 million.

The lawsuits claim the apartment complex and Multi-South Management Services, the management agency, should have been aware of the criminal activity that happened at and in the area of the Memphis apartment complex located on Scott Crossing Drive.

All three of the women argue that the area and the complex itself had a history of forced entries, burglaries, and similarly perpetrated armed sexual assaults against young women occurring within the days prior to their assaults. The women also believe the apartment's management knew an armed rapist roamed the area and had open and free access to the apartment complex.

Memphis police say the attacks happened February 9, 12, and 14. All three times, the rapist, who is described as a 5-foot-7 inch man with a thin build, somehow entered the victims' apartments armed with a handgun.

Investigators charged 25-year-old DeAndrey Peterson with two counts of aggravated rape and aggravated burglary after an early morning attack that happened at the end of March.

The lawsuit contends that The Abington mismanages its tenants and property, which jeopardizes safety. More than 200 unoccupied apartment units could easily serve as a haven for criminals, according to the lawsuit.

In seeking to recover monetary damages, the women want to hold the apartment's management accountable by raising the level of awareness regarding vulnerable single women in apartment complexes.

One of the victims, who wished to keep her identity concealed, told WMC Action News 5's Jason Miles she now lives with her mother since the string of attacks in complex in Raleigh.

"A man assaulted me, he came into my home, and he was armed," she said. "Thought he was going to kill me."

This victim says an upstairs neighbor was raped before her, but she was never alerted. Attorney Walter Bailey represents all three victims.

"They [management] had every reason to foresee this occurring as a result of the first assault, and it's our position they took no measures commensurate with the danger," he said.

WMC Action News 5 reached out to the apartment complex and the management agency, but neither provided comment as of Wednesday night.
