Danny Mack Jordan, 65, currently incarcerated and charged with the murder of his wife, Shelley Myers Jordan, now claims he has been jailed illegally.
In court documents filed earlier this week, Jordan claims to have been confined and restrained without probable cause, violating his 4th and 14th amendment rights.
He has requested an evidentiary hearing and hopes to be released based on an absence of probable cause.
The hearing is scheduled for June 20 at 9:30 a.m. before Judge Brad Underwood.
The remains of 62-year-old Shelley Myers Jordan were found on a road in North Lubbock County just down the street from her husband's home on May 29.
The victim's son-in-law, Sean Huntsman, says that three and a half years ago Danny Jordan was declared mentally incompetent. He says doctors believed that Danny Jordan had a form of dementia.
Shelley Jordan was appointed as Danny's legal guardian in 2011. Two years later, Shelley and Danny moved from their home on North Frankford into the home on Detroit Avenue.
Shelley's daughter found blood on the wall under her home office desk in that location after she was reported missing.
