Nicholas Melton is currently behind bars, charged with five counts of aggravated assault and causing bodily injury with a deadly weapon.
Melton is the man accused of intentionally ramming his pickup truck into multiple vehicles at the 82nd Street Walmart back in May.
Melton's attorney has filed paperwork stating that Melton is being unlawfully restrained by Lubbock Sheriff Kelly Rowe and being denied his right to reasonable bail under the 8th amendment.
Melton will go before a judge on Tuesday at 8:30 a.m.
