Perry calls indictment 'abuse of power'

AUSTIN, TX (KXAN/CNN) - Gov. Rick Perry is gearing up for a fight.

The Republican on Saturday slammed an indictment alleging he abused his power by threatening to veto funding for an ethics unit run by a county district attorney who was convicted of drunken driving.

Perry is standing behind his veto and says he'll fight those who he says are motivated by politics.

"This indictment amounts to nothing more than abuse of power, and I cannot and I will not allow that to happen," he said.

Perry said the public lost confidence in District Attorney Rosemary Lehmberg in reference to her drunken driving case.

"I think Americans and Texans who have seen this agree with me, that that is not an individual who is heading up an office that we can afford to fund," he said.

Gilberto Hinojosa, the Texas Democratic Party executive director, doesn't agree with the governor.

"Twenty-six million Texans woke up this morning not facing two felony indictments and their governor did. This in unbecoming of their chief law enforcement official in Texas," he said. "His ambitions are to run for higher office. And, in the process, he has abused his constitutional authority and his power here in Texas, and that's why he needs to step down."

What affect this will have on possible political ambitions for the governor has yet to be seen.

The special prosecutor in the case, Michael McCrum, told the San Antonio Express-News the claim the case was politically motivated was "not only ridiculous, but it's disappointing."

He says the case has "always been about the facts and the law."
