He's already in prison but the former Texas Tech professor who caused a bubonic plague scare is appealing his conviction. Dr. Thomas Butler's attorney says the appeal seeks to overturn the conviction on 47 felony counts of embezzlement, mail and wire fraud.
Arguments began in the 5th Circuit Court of Appeals in New Orleans Monday. It may be 4 to 6 weeks before a decision is made in the case. So far, Butler has served one year of his two year sentence.
