It now appears that the woman convicted of intoxication manslaughter for the death of a bicyclist will not get a new trial.
Judge Darnell failed to make a decision by five o'clock Wednesday, meaning the motion for Callie Long's new trial is over-ruled. The defense has ninety-days to appeal the conviction from the date it was handed down, which was April 22nd.
Jurors sentenced Long to two years in prison but she will remain free until this next appeal is settled.
