LUBBOCK COUNTY, TX (KCBD) - On Monday, the 140th Judicial District Court for Lubbock County dismissed the latest effort to delay the execution of convicted murderer Rosendo Rodriguez, III.
Rodriguez is scheduled to be executed on Tuesday, March 27.
Rodriguez has been convicted of murdering Summer Baldwin, who was pregnant at the time. He also admitted to killing Joanna Rogers.
Rodriguez's attorney, Seth Kretzer, is now turning to the Court of Criminal Appeals in hopes of delaying the execution after learning about a lawsuit involving the Lubbock County Medical Examiner's office.
Kretzer said the Supreme Court has a staff dedicated to death penalty cases and a last minute stay can halt an execution.
