Federal Judge Sam Cummings is sending a felon a warning Thursday. He says he will not go lightly on sentencing the man who left a gun sitting on the steps of a Lubbock apartment building.
Aaron Fulcher is charged with felon in possession of a fire-arm. Judge Cummings put Fulcher "on notice" saying he will consider more than the guideline sentence for the crime.
In 2004, Fulcher left a handgun within reach of his 11-year-old nephew. The boy, Ronald Williams found the gun and accidentally shot and killed himself.
Fulcher's sentencing is set for January 27th. He faces a maximum ten years in prison.
