A Lubbock murderer is making every effort to avoid execution. Friday, a federal court denied a stay of execution for Robert Madrid Salazar. Friday's rejection comes one week after the Texas Court of Criminal Appeals denied his appeal.
Salazar is claiming he is mentally retarded. Nine years ago, he beat his girlfriend's 2-year-old daughter to death inside a central Lubbock home. Salazar's New Mexico attorney says they are filing another appeal in the U.S. Supreme Court.
His execution is set for Wednesday.
