Trial began Tuesday to determine the sentencing of a Lubbock man convicted of murder six years ago.

This is the second sentencing trial for Joe Franco Garza Jr. In his first trial he received the death penalty. However,Garza claimed crucial testimony about his troubled past was not used in court and a federal judge overturned that sentence. Now a jury must decide Garza's punishment for the murder of Silbiano Rangel all over again.

Prosecutors say they will once again seek the death penalty.
