The U.S. Supreme Court will not review the case involving the 2003 Texas Tech bio terrorism scare. The court denied Dr. Thomas Butler's request to review his case.

Butler is the former Texas Tech researcher who reported vials of the plague stolen. He later admitted he may have accidentally destroyed them. Butler completed a two year prison sentence last November.
