Teen Overdose Death Civil Lawsuit A Bust - KCBD NewsChannel 11 Lubbock

A civil lawsuit filed against a Lubbock doctor and eight teens may not happen afterall. The family of 16 year-old Thomas Mallory filed the lawsuit last August, just three months after their son's death.

Sources tell us "more than likely" there will be no pay out to Mallory's family and the lawsuit may not go to trial.

Again,  sources say all parties agreed two weeks ago to file a motion to dismiss the case. Because there is a gag order,  no one could comment on the circumstances behind the dismissal.

Last summer, Mallory overdosed on ecstacy while the teens who were with him waited four hours before calling for help.

Mallory later died at the hospital. He was 16 years-old.
