Accidental Shooting Case Involving Three Lubbock Boys Goes To DA

Lubbock Police are expected to turn their findings in a burglary turned accidental shooting over to the District Attorney's office Wednesday.

Police say an 11-year-old boy and 9-year-old friend were allegedly breaking into a car in Northeast Lubbock Monday. Police believe the 11-year-old's 10-year-old brother acted as the lookout. They say the kids found a gun in the car and when the gun went off, the 10-year-old was grazed by the shotgun pellets. But, the child's mother says that's not what happened.

"I just don't want people to say that my son shot his brother, he didn't. He's already upset that his brother has been shot. They made a bad mistake," explained Andrea Washington.

The 10-year-old underwent minor surgery on Wednesday for his injuries. Police say the gun's owner David Hightower will not face charges, but they say the 10 and 11-year-old could face charges because of the alleged burglary. The 9-year-old is too young to face charges.
